Ms. Costello is very sharp when it comes to this issue. You'll enjoy reading this, if just to see how sticky and gray the issue of copyright infringement is.

Fairey v. Associated Press: A Case Study of Copyright Infringement and Copyright Fair Use
Interesting article. Restraints of the trial by jury to prevent jury nullification was one of the issues that led to the revolution. If I remember correctly, there was a case where John Adams argued on behalf of John Hancock for jury nullification. I wonder if this will gain any traction in federal prosecutions of medical marijuana users that are authorized to use or grow marijuana under state law.

Civil Liberties Examiner: Jury nullification at work in marijuana, gun cases
I wonder what this means for post-domain paths that do signify source, such as Facebook's canvas URLs. Hopefully they will not get lumped into this precedent.

Anti-Cyber Squatting Consumer Protection Act Update
Good article. The majority of my 3L friends are looking at LLM or MBA programs to delay their entry into the job market and to defer student loans. The rest... well they are certainly panicking. It has become more and more difficult to get a public interest job as well.

Wow. Scary stuff. Though it is a bad time to be a 3L, its probably the best time to learn to work for yourself.

U.S. Legal Job Market Contracts in 2008
This has been needed for years. The FCC had a M&O floating around on this issue a last year but apparently nothing came of it. It is important that GSM cellphone users have the ability to use their phones in the EU.

EFF Asks Copyright Office TO Exempt "Cell Phone Locks" From DMCA "circumventing technical protection measures."
I don't blame Twitter for turning down Facebook stock. Facebook is grossly overvalued and their business model needs to be fully worked out before any stock is given away as if it has value. Hopefully the execs at Twitter learned the lessons of the last tech bubble, though Twitter itself has monetization problems.

Hopefully Google can make Skype profitable. There are a lot of foreign users of Skype and it would be a great way to take advantage of the network effects that Google Talk sorely lacks.

Rumour: Google to buy Skype
It would be really nice if we could get some reciprocity in the EU as well, through treaty or otherwise.

Uniform Bar Exam Inches Closer to Reality
Sounds impossible. But I would love to see it happen. The whole world is going to uniform standards. Why not law?

Of course the illegal downloads occurred because someone did not want to pay for the songs! Not-Guilty :-)

Dear RIAA: A Download Does Not Equal A Lost Sale. Copyright thieves may not have paid for those songs!
With all the free porn that is out there, can the 'pay for porn' industry really be saved?

interesting video Ray, the argument for the worth of works in the public domain does not get enough attention IMHO.

What is the number one complaint by clients? Lack of lawyer communication. I guess number two would be lawyer misinformation.

Eight Years Of Lawyer Misrepresentations To His Client
The whole "lawyers are above" advertising thing is egominiacal joke. The sooner lawyers come down to earthy and stop seeing themsleves above the rest, the better off consuemrs and lawyers will be in the end.

I'm shocked, but this could just be another bungled PR attempt. The RIAA has a knack for them after all.

Yes I know. There was a little blog conversation on that site as well... I didn't realize when responding there that his comment was posted on multiple sites. Agitating at best, great shot of my sign though.
